Terms & Conditions

Last updated: 5 November 2026

1. Introduction and definitions

1.1 These Terms. These terms of service (Terms) govern your use of stax.com.au and any related STAX. website (Site), and any purchase of goods (Goods) through the Site. The Site is operated by STAX COLLECTIVE PTY LTD (ACN 700 813 921) (ABN 35 700 813 921) trading as STAX. (STAX., we, us, our).

1.2 Acceptance. By accessing the Site or placing an order (Order), you agree to be bound by these Terms and the policies referred to in them, including our Shipping Policy, Returns Policy and Privacy Policy (Policies). If you do not agree to these Terms, you must not use the Site.

1.3 Eligibility. You must be at least 18 years old to place an Order. If you are under 18, a parent or guardian must place the Order or be involved in placing it.

1.4 Changes to these Terms. We may amend these Terms at any time by publishing the amended version on the Site. The Terms published at the time you place an Order apply to that Order.

1.5 Order of precedence. If these Terms are inconsistent with a Policy or with the terms of a specific promotion, the more specific document prevails to the extent of the inconsistency.

1.6 Use outside Australia. The Site is intended for customers in Australia and the countries we ship to. If you access it from elsewhere, you are responsible for complying with your local laws. Section 8 sets out additional rights for customers in the United Kingdom and European Union.

1.7 Definitions. In these Terms, ACL means the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth), and business day means a weekday other than a public holiday in New South Wales. Other terms in bold are defined where they first appear.

2. Accounts and loyalty

2.1 Your account. Some features of the Site may require an account. You must provide accurate information and keep it up to date.

2.2 Security. You are responsible for keeping your login details confidential and for all activity on your account. You must notify us promptly at help@stax.com.au if you suspect unauthorised access.

2.3 Loyalty program. Any loyalty or rewards program we offer will be governed by its own terms, published on the Site.

3. Products and pricing

3.1 Product information. We take reasonable care to describe and display Goods accurately. However, colours may appear differently depending on your screen, and our size guide is a general guide only; fit may vary between styles and production runs. Items styled with a product in images are not included unless stated.

3.2 Care. You should follow the care instructions on each product's label and product page. Damage caused by not following them is not a fault (see clause 7.4).

3.3 Availability. All Goods are subject to availability, and we may limit the quantity of Goods available to each customer, household or Order. If Goods you have ordered become unavailable, we will notify you and refund the amount paid for those Goods.

3.4 Price changes and errors. Prices may change without notice, but changes will not affect Orders already placed, except under this clause. If Goods are listed at an obviously incorrect price or with incorrect information, we may cancel the affected Order, even after it has been placed, and refund you in full. We will notify you before doing so.

3.5 Reference prices. Where a price is shown crossed out next to a lower price, the crossed-out price is a price at which we have previously offered those Goods on the Site for a reasonable period.

3.6 Currency, GST and duties. Prices are shown in the currency set for your country at checkout, or in US dollars (USD) where your currency is not available. Prices for delivery within Australia include GST. International prices are converted from Australian dollars using exchange rates we set, which may differ from the rates shown by currency converters. For delivery outside Australia, you are responsible for any import duties, taxes and fees, unless checkout states otherwise. Your bank or card provider may also charge currency conversion fees.

3.7 Recalls. If Goods are recalled, you agree to follow our reasonable instructions about their return or disposal, and to pass the recall notice on to anyone you gave the Goods to.

4. Orders and payment

4.1 Offer and acceptance. Placing an Order is an offer to buy the Goods in it. Our order confirmation email acknowledges receipt of your Order only. A contract is formed when we dispatch the Goods.

4.2 Our right to refuse or cancel. We may refuse or cancel all or part of an Order, and will refund any amount paid for the cancelled Goods, where:

  • (a) the Goods are unavailable, or were listed with an incorrect price or description;
  • (b) we suspect fraud, or cannot verify your identity or payment;
  • (c) the Order exceeds our quantity limits or appears to be for resale;
  • (d) we cannot deliver to the address provided; or
  • (e) you have breached these Terms.

4.3 Changes and cancellations. If you need to change or cancel an Order, email help@stax.com.au as soon as possible. We will try to action your request before the Order is dispatched, but cannot guarantee that we will be able to do so. Once an Order has been dispatched, our Returns Policy applies. This does not affect your rights under the ACL or section 8.

4.4 Payment. Payment in full is required when you place an Order. We accept the payment methods shown at checkout, currently major credit and debit cards, PayPal, Apple Pay and Afterpay. Buy-now-pay-later services are provided by third parties under their own terms. Payment by fraudulent or unlawful means is prohibited.

4.5 Pre-orders. We may offer some Goods for pre-order with an estimated dispatch date. Payment is taken when you place the pre-order. Estimated dates may change, and we will notify you of any significant delay. You may cancel a pre-order for a full refund at any time before it is dispatched.

5. Promotions, store credit and gift cards

5.1 Discount codes. Unless the terms of a specific promotion state otherwise:

  • (a) only one discount code may be used per Order, and codes cannot be combined with other offers (Store Credit and gift cards are payment methods, not offers, and may be used with a code);
  • (b) codes are not valid on sale Goods or Goods in our Outlet collection;
  • (c) codes cannot be applied after an Order has been placed; and
  • (d) codes have no cash value and may be changed or withdrawn at any time.

5.2 Misused codes. We may cancel an Order, or remove a discount from it, where a code was used by mistake or in breach of its conditions. This includes affiliate, ambassador or creator codes used outside the audience they were issued for.

5.3 Price adjustments. We do not offer price adjustments if the price of Goods falls after you have placed your Order.

5.4 Promotional terms. Specific promotions and competitions may be subject to their own terms, published on the Site.

5.5 Store credit. Store credit (Store Credit) is issued as follows:

  • (a) If you return Goods for Store Credit under our Returns Policy, we will issue Store Credit equal to 110% of the amount you paid by card, PayPal or Afterpay for those Goods.
  • (b) If you return Goods purchased using Store Credit or a gift card, we will return that amount at its original value. No further bonus applies.
  • (c) Store Credit expires 3 years from the date of issue.
  • (d) Store Credit is not redeemable for cash and is not transferable.

5.6 Gift cards. Gift cards are valid for 3 years from the date of purchase. They are not redeemable for cash, and we are unable to replace lost or stolen gift cards.

6. Delivery and risk

6.1 Delivery. We deliver using Australia Post. We do not currently deliver to the United States. Delivery times and costs are set out in our Shipping Policy. Any delivery date we give is an estimate only.

6.2 Delivery address. You must provide a complete and accurate delivery address. We are not responsible for Goods delivered to an incorrect address you have provided. Address changes are subject to clause 4.3.

6.3 When delivery occurs. Delivery occurs when Australia Post records the Goods as delivered to your address, including where they are left in a safe place (safe drop). Parcels may be left by safe drop unless a signature is requested, where Australia Post offers this. You can set your signature and delivery preferences in the Australia Post app. Risk in the Goods passes to you on delivery.

6.4 Lost, missing or damaged parcels.

  • (a) If tracking for your Order has not updated for 5 business days, contact us at help@stax.com.au. We will lodge a claim with Australia Post and keep you informed.
  • (b) If tracking shows your Goods as delivered but you have not received them, you must notify us at help@stax.com.au within 7 days of the delivery date. If your Goods arrive damaged, please notify us at help@stax.com.au as soon as possible, with photos of the parcel and Goods. We will lodge a claim with Australia Post and keep you informed.

If Goods are lost or damaged before delivery, we will replace or refund them.

6.5 Undeliverable parcels. If Goods are returned to us because they could not be delivered or were not collected, we will contact you to arrange redelivery. Additional shipping charges may apply where the parcel could not be delivered because of an incorrect address or because it was not collected. Further details are set out in our Shipping Policy.

7. Returns, faulty Goods and consumer guarantees

7.1 Returns. Change of mind returns, exchanges and refunds are governed by our Returns Policy. Goods in our Outlet collection are final sale and cannot be returned or exchanged for a change of mind. This does not affect your rights for Goods that are faulty or not as described. When you request an exchange, you authorise us to place a temporary hold on your nominated card for the value of the replacement Goods. The hold is released once we receive your returned Goods, and if we do not receive them within 28 days of your exchange request, you authorise us to charge the hold amount.

7.2 Consumer guarantees. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

7.3 Faulty Goods claims. If you believe Goods are faulty, email help@stax.com.au with your order number and photos of the issue. We will assess your claim and notify you of the outcome. You should not wear or wash the Goods further while they are being assessed.

7.4 What is not a fault. The following are not faults:

  • (a) normal wear and tear;
  • (b) misuse or accidental damage;
  • (c) damage caused by not following the care instructions; and
  • (d) minor variations in colour or finish consistent with the product information.

7.5 Your rights preserved. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the ACL or any other law that cannot lawfully be excluded, restricted or modified.

8. UK and EU customers

8.1 Application. This section applies if you are a consumer resident in the United Kingdom or the European Union. It applies in addition to our Returns Policy and prevails to the extent of any inconsistency.

8.2 Right to cancel. You may cancel your Order for any reason within 14 days of the day you receive the Goods. This applies to all Goods, including sale Goods and Goods in our Outlet collection, except as set out in clause 8.5. To cancel, you must start a return through our returns portal within that period.

8.3 Returning Goods. You must return the Goods within 14 days of notifying us. Unless the Goods are faulty, you are responsible for the cost of return postage.

8.4 Refunds. We will refund the price of the Goods and the standard delivery charge to your original payment method within 14 days of receiving the Goods back, or proof that you have sent them back, whichever is earlier. We may reduce the refund to reflect any loss in value caused by handling the Goods beyond what is necessary to check their nature and fit.

8.5 Exceptions. For hygiene reasons, underwear, socks and swimwear supplied in sealed packaging or with a hygiene liner cannot be returned under this section once the seal or liner has been removed.

8.6 Statutory rights. You retain all rights under the consumer laws of your country of residence, including for faulty Goods, and may bring proceedings in the courts of that country.

9. Liability and indemnity

9.1 Indirect loss. To the extent permitted by law, and subject to clauses 7.2 and 7.5 and section 8, we are not liable for any indirect or consequential loss, or any loss of profit, revenue, data or opportunity, arising from your use of the Site or the Goods.

9.2 Site information. Information on the Site is provided for general purposes. To the extent permitted by law, we do not warrant that it is complete, current or free from errors.

9.3 Indemnity. You indemnify us against any loss, damage, cost or expense (including reasonable legal costs) we incur as a result of your breach of these Terms, your misuse of the Site, or your infringement of any third party's rights, except to the extent caused by our own act or omission.

10. Intellectual property and use of the Site

10.1 Ownership. All content on the Site, including the STAX. name and logo, designs, images, videos and text, is owned by or licensed to us and is protected by intellectual property laws.

10.2 Licence to use. You may access and view the Site for your personal, non-commercial use only. You must not copy, reproduce, modify or commercially use any content on the Site without our prior written consent.

10.3 Prohibited use. You must not:

  • (a) use the Site for any unlawful, fraudulent or harmful purpose;
  • (b) scrape, crawl or extract data or content from the Site, or use bots, scripts, automated tools or AI agents to access the Site or place Orders, without our prior written consent;
  • (c) interfere with or attempt to circumvent the Site's security or operation, or introduce any malicious code;
  • (d) impersonate any person or provide false information; or
  • (e) purchase Goods for resale without our written agreement.

10.4 Site availability. We do not guarantee that the Site will be available at all times or free from errors. We may change, suspend or withdraw any part of the Site at any time without notice.

10.5 Chat and AI assistance. Our customer service chat may be assisted by artificial intelligence. Responses provided through chat do not vary these Terms or our Policies, which govern your Order. This does not affect your rights under the ACL.

10.6 Third-party services. The Site may link to or use third-party services, including payment, buy-now-pay-later and returns providers. We are not responsible for their content or services, which are subject to their own terms.

11. Reviews and user content

11.1 User Content. User Content means any reviews, comments, images, videos or other material you submit to the Site or share with us, including social media posts that tag STAX. or use our hashtags (User Content).

11.2 Reviews. Reviews must be genuine and based on your own experience with the Goods. We publish both positive and negative reviews. We may decline to publish, or remove, any review that is unlawful, offensive, spam, unrelated to the Goods, or not from a genuine customer.

11.3 Licence to use social content. If you tag STAX. or use our hashtags on social media, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and share that User Content on our website, social media channels, emails and advertising, crediting your handle where practicable. No payment is due for this use.

11.4 Removal. If you ask us to stop using your User Content by emailing help@stax.com.au, we will remove it from our channels within a reasonable time and will not use it in new material.

11.5 Your warranties. By submitting User Content, you confirm that you own it or have permission to share it, that anyone identifiable in it has consented, and that it does not infringe any law or third-party right.

12. Communications and privacy

12.1 Service communications. By placing an Order, you consent to receiving communications about your Order, delivery, returns and account by email and SMS. Communications are taken to be received when sent to the contact details you have provided.

12.2 Marketing. We will only send you marketing emails or SMS where you have consented to receive them. You may unsubscribe at any time using the link in our emails or by replying STOP to our SMS.

12.3 Privacy. We collect and handle your personal information in accordance with our Privacy Policy.

13. General

13.1 Complaints. To make a complaint, email help@stax.com.au with your order number and details of the issue. If you are not satisfied with our response, you may contact NSW Fair Trading or the consumer protection agency in your state or country.

13.2 Suspension and termination. We may suspend or terminate your access to the Site or your account, or cancel any Order, if you breach these Terms. Where we cancel an Order for any other reason, you will receive a full refund.

13.3 Events beyond our control. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, industrial action, carrier disruptions, pandemics and system outages. This does not affect your rights under the ACL.

13.4 Governing law. These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of its courts. This clause is subject to section 8.

13.5 Severability. Any provision of these Terms found to be invalid or unenforceable will be severed, and the remaining provisions will continue in effect.

13.6 Waiver. A failure or delay by us in exercising a right does not waive that right.

13.7 Entire agreement. These Terms and the Policies form the entire agreement between you and us regarding your use of the Site and your Orders.

13.8 Assignment. We may assign or transfer our rights under these Terms. You may not do so without our prior written consent.

13.9 Survival. Clauses which by their nature are intended to survive, including sections 9, 10 and 11, survive the termination of these Terms.
